The Minnesota Court of Appeals has upheld a lower court’s decision awarding Kim Lund 45.2 million dollars for her stake in Lunds and Byerlys. Lund sued the grocery store chain and her brother Tres Lund, the firm’s C-E-O, to cash out of the company. The appeals panel says the district court “did not abuse its discretion in granting a buy-out of Kim’s interests as an equitable remedy for unfairly prejudicial conduct.” The judges add that the lower court “acted well within its discretion in determining fair value.” All four Lund siblings took the stand in a highly-publicized trial in 2017.
