Charges against a man accused of killing the granddaughter of American Indian Movement co-founder Dennis Banks have been upgraded to second-degree intentional murder — that after an autopsy found 31-year-old Rose Downwind died of strangulation, not from falling down the stairs as her ex-boyfriend told police. The charge against 40-year-old Marchello Cimmarusti (sim-uh-ROOST-ee) carries a maximum sentence of 40 years in prison. Downwind’s burned body was in a shallow grave northwest of Bemidji in December.
