A resident of Lieutenant Governor Michelle Fischbach’s state Senate district is suing, alleging she can’t serve in that position and as a state senator at the same time. The plaintiff is Sauk Rapids resident Destiny Dusosky, who’s been D-F-L chair in the Paynesville-area Senate district. Senate Majority Leader Paul Gazelka says “Democrats are attempting to force an influential Republican woman out of her duly elected position in the Senate.” Republicans don’t want to risk losing a special election for Fischbach’s seat, because that could give Democrats majority control of the state Senate. Democratic Minority Leader Tom Bakk says Fischbach’s attempt to hold offices in both the legislative and executive branches at the same time is a clear violation of the separation of powers clause in the Minnesota Constitution.
