Senator Al Franken at hearings Wednesday grilled Equifax’s former Chairman and C-E-O Richard Smith about a major data breach affecting 145 million Americans and two million Minnesotans. Franken keyed in on Smith’s statement that it was a mistake that a forced arbitration clause was included in a product to assist people affected by the data breach. Smith told lawmakers, “The arbitration clause was removed within 24 hours.” But Franken wanted to know, are forced arbitration clauses still included in Equifax’s *other* products? “Are you suggesting that every other consumer who may have been cheated or mistreated by Equifax is not worthy of the same access to justice?” he asked. Smith responded, “On the breach solution that was offered?” Franken fired back, “No, no, I asked you a question and I just really would like you to answer the question.” Smith responded, “I said, yes, it’s in the products that we sell.”
