A three-judge panel of the state Court of Appeals has upheld Winona County’s ban on frac sand mining and says the company that sued does *not* have a legal right to compensation. Officials with sand-mining company Minnesota Sands disagree, saying Winona County’s ban violates the Commerce Clause of the U-S Constitution — and they say they’re considering options which could include an appeal. In 2016 Winona County was the first in Minnesota to enact a ban on frac sand mining.
