A former Metro Transit train driver who disregarded a stop signal and hit a vehicle on University Avenue in Saint Paul last July, killing its driver, cannot be charged because of what officials term a “hole” in state law, reports the Star Tribune. Ramsey County prosecutors declined in February to charge Abdellatif El Maarouf with criminal vehicular operation because they couldn’t prove gross negligence. And city prosecutors now say they can’t charge the man with a lesser violation such as careless driving because trains aren’t considered “vehicles” under state law. 29-year-old Nicolas Westlake died in the crash.
