Governor Mark Dayton is reviewing his options after North Dakota won a round in federal court over a Minnesota law restricting imports of electricity from power plants that increase greenhouse gases. North Dakota interests argue the Minnesota law hampers their ability to sell power to Minnesota from new coal-fired plants. A federal appeals court Wednesday upheld a lower court ruling, saying the federal government has “exclusive jurisdiction to regulate wholesale sales and the transmission of electric energy” between states. Governor Dayton responds he will “continue to defend the State of Minnesota’s right to protect the quality of the air our citizens breathe.”
