State lawmakers are on holiday break, even as another legal battle brews between Democrats and Republicans in the Minnesota Senate. It’s fallout from the impending resignation of Senator Al Franken. The Minnesota Senate president, Paynesville Republican Michelle Fischbach, will become lieutenant governor when current Lieutenant Governor Tina Smith leaves to replace Franken in Washington D-C. Republican leaders, who don’t want to risk losing a special election in Fischbach’s district, say an 1898 state Supreme Court ruling allows Fischbach to continue serving in the Senate while she’s lieutenant governor. Democrats say not so and are threatening to sue.
